§1 applicability to entrepreneurs and definitions

1. the following terms and conditions apply to all deliveries between us and a consumer in the version valid at the time of the order.

2. a consumer is any natural person who enters into a legal transaction for purposes that are predominantly not attributable to their commercial or independent professional activity (§ 13 bgb).

§2 formation of a contract, storage of the contract text

1. the following rules regarding the conclusion of a contract apply to orders placed through our online shop at https://www.madman-culture.com.

2. in the event of a contract conclusion, the contract is formed with:

3. the presentation of products in our online shop does not constitute a legally binding contractual offer but rather a non-binding invitation for consumers to order goods. by placing an order for the desired goods, the consumer submits a binding offer to conclude a purchase contract.

4. when an order is placed in our online shop, the following process applies: the consumer submits a binding contractual offer by successfully completing the order procedure provided in our online shop.

   the order involves the following steps:

   1. selection of the desired product(s).
   2. confirmation by clicking the “add to cart” button.
   3. reviewing the items in the shopping cart.
   4. clicking the “checkout” button.
   5. logging into the online shop after registering and entering login credentials (email address and password).
   6. reviewing and, if necessary, correcting the entered data.
   7. submitting the order by clicking the “pay now” or “buy” button.

   before the final submission of the order, the consumer can return to the page where the customer details were entered and correct input errors using the “back” button in their web browser. alternatively, they can cancel the order process by closing the browser. we immediately confirm receipt of the order with an automatically generated email (“order confirmation”). with this email, we accept your offer.

5. storage of the contract text: for orders placed through our online shop, we save the contract text and send you the order details and our terms and conditions via email. the terms and conditions can also be accessed at any time at https://www.madman-culture.com/agb. past orders can be viewed in the “my account” section under “orders.”

§3 prices, shipping costs, payment, and due date

1. the prices listed include statutory value-added tax and other price components. additional shipping costs may apply.

2. consumers may pay via paypal, apple pay, google pay, klarna, shop pay, union pay or credit cart( visa, mastercard, american express).
   

§4 delivery

1. unless otherwise clearly stated in the product description, all items offered by us are ready for immediate shipment. delivery will take place no later than seven working days. the delivery period begins on the day following the payment order to the bank (in the case of advance payment) or on the day after contract conclusion (for all other payment methods). if the delivery period ends on a saturday, sunday, or public holiday at the delivery location, it will be extended to the next working day.

2. the risk of accidental loss or deterioration of the sold goods does not pass to the buyer until the goods are handed over, even in the case of a shipment purchase.

§5 retention of title

we retain ownership of the goods until full payment of the purchase price has been made.

§6 shipping

§7 cancellation terms as well as statutory right of cancellation

we grant our customers a contractual right of cancellation in addition to the statutory right of cancellation. the contractual right of cancellation is regulated in our contractual cancellation terms.
